Terms of Service

1. Acceptance of Terms

By accessing or using DermaRadar ("Service"), you agree to be bound by these Terms. If you do not agree, do not use the Service.

2. Description of Service

DermaRadar provides dermatologists with market intelligence on payer reimbursement rates, drawn from publicly available CMS Transparency in Coverage data. The Service includes rate comparisons, benchmark analytics, and negotiation letter generation tools.

3. Eligibility

The Service is intended for licensed healthcare providers and their authorized staff. By registering, you represent that you are at least 18 years old and authorized to enter into this agreement.

4. Subscription & Payment

  • Subscriptions are billed monthly or as a one-time upfront payment as selected at checkout.
  • Founding Member pricing applies for the first three months of your subscription. After that, standard pricing applies.
  • All payments are processed securely via Stripe. DermaRadar does not store payment card data.
  • Subscriptions auto-renew unless cancelled before the next billing date.

5. Refund Policy

You may cancel your subscription at any time. Refunds are not issued for partial billing periods. If you experience a billing error, contact us within 30 days.

6. Data & Privacy

  • DermaRadar does not collect, store, or process any Protected Health Information (PHI). Rate data is sourced from publicly available federal datasets.
  • Your NPI number is used solely to look up publicly available rate information and is not sold or shared with third parties.
  • We collect basic account information (name, email, payment details) to operate the Service.

7. No Medical or Legal Advice

The information provided is for informational and negotiation-support purposes only. DermaRadar does not constitute legal, financial, or medical advice. You are solely responsible for how you use the data in your payer negotiations.

8. Accuracy of Data

Rate data is sourced from CMS machine-readable files published by payers under the Transparency in Coverage rule. DermaRadar makes no warranties about the completeness or real-time accuracy of this data. Rates may not reflect your current contract terms.

9. Acceptable Use

  • Resell, sublicense, or redistribute data obtained through the Service
  • Use the Service to build a competing product
  • Attempt to reverse-engineer or scrape the platform
  • Use the Service in any way that violates applicable law

10. Intellectual Property

All platform design, software, and compiled data products are the property of DermaRadar. Rate data sourced from federal databases remains in the public domain.

11. Termination

We reserve the right to suspend or terminate accounts that violate these Terms, with or without notice. Upon termination, your access to the Service ends immediately.

12. Disclaimer of Warranties

The Service is provided "as is" without warranties of any kind, express or implied, including but not limited to merchantability or fitness for a particular purpose.

13. Limitation of Liability

DermaRadar, its owners, employees, and affiliates are not liable for any damages, losses, or harm of any kind arising from your use of the Service — including but not limited to financial loss, lost revenue, data loss, or reliance on information provided. Use of the Service is entirely at your own risk.

14. Changes to Terms

We may update these Terms at any time. We will notify you by email or in-app notice. Continued use after the effective date constitutes acceptance.
